They put money into a film, and somewhere along the way it became unclear whether their money was funding that film specifically, or the producer's whole slate of projects, past and future. That confusion alone has killed deals that had nothing wrong with the actual film. The fix is one of the least exciting pieces of production planning, and one of the most important. Set up a single purpose LLC for the project before you take a single dollar. Ferdy adimefe What a Single Purpose LLC Actually Is Here's the part that surprises people. A single purpose entity, or SPE, "is not a type of entity, it is a purpose. Most Film SPEs are LLCs, but what makes them an SPE is that they exist for one project only". It's not a different legal category from any other LLC. It's a regular company that you deliberately choose to use for exactly one film, and nothing else, ever. That single LLC becomes the container for everything tied to the project, the copyright, the production contracts, investor funds, insurance policies, and distribution agreements. When the film is done and sold, the money flows through that one entity, not through whatever company the producer happens to run day to day. Why Investors and Distributors Actually Care About This There's a specific complaint that keeps showing up in Nigerian film financing discussions, and it's exactly... - Published: 2026-09-02 - Modified: 2026-09-02 - URL: https://theferdyadimefe.com/why-chain-of-title-decides-if-your-film-ever-gets-distributed/ - Categories: Uncategorized - Tags: film distribution legal requirements A producer friend once showed me a distribution contract that had stalled for four months. Not because the buyer changed their mind. Because nobody could produce a signed document proving who actually owned the music in one scene. The film was finished. The deal was verbally agreed. And it sat there anyway, because paperwork that should have existed from day one didn't. That's chain of title, and it's the least glamorous, most decisive piece of infrastructure in this entire industry. What Chain of Title Actually Means? Chain of title is the documented history of who owns the rights to every creative element in your production, from the original screenplay through to the finished, distributable film. The concept borrows directly from real estate law. Every time a right changes hands, whether that's a screenwriter assigning their script to a producer, a composer licensing a score, or an actor signing a performance release, that's one link in the chain. Every link has to be documented, unbroken, and legally sound before anyone downstream can safely acquire the finished work. Here's the part that catches people off guard. A missing signature on one release form, an unsigned assignment from a co-writer who's since gone quiet, an undocumented handshake deal for a song, any single gap "can delay or kill a distribution deal regardless of the film's creative quality". The film doesn't have to be flawed. The paperwork just has to be incomplete. Now the Real Strategy Begins. I've sat in enough festival lounges now to notice a pattern. Every first-time filmmaker walks in with the same plan. Submit to Cannes, submit to Sundance, wait. That's not a strategy. That's a lottery ticket with an entry fee attached. Here's the hierarchy I've come to understand, partly from attending these rooms myself and partly from digging into how the industry actually structures itself. Once you see it, you stop wasting submission fees on festivals that were never going to say yes to your first film anyway. Ferdy Adimefe The Top Tier Isn't Wrong. It's Just Not for You Yet. Cannes, Toronto, Berlin, Sundance, Venice, and Rotterdam sit at the top of this hierarchy, and Raindance's own festival school describes this tier plainly as where "the highest acquisition executive attendance" happens. That's the actual reason these festivals matter. It's not the red carpet. It's the sheer volume of buyers in one building, people who can change your distribution conversation permanently the moment they see your name attached to something. But a first film, without star power or an existing franchise behind it, is not what gets pulled from thousands of submissions at that level. That's not a knock on your work. It's just where the odds sit, and knowing that going in saves you from reading rejection as a verdict on your talent. The Middle Tier Is Where Most Careers Actually Start Below the top sits what the industry calls the... - Published: 2026-08-27 - Modified: 2026-09-02 - URL: https://theferdyadimefe.com/why-creating-ip-and-owning-ip-are-different-jobs-in-africa/ - Categories: Uncategorized - Tags: African animation IP deals, copyright enforcement Africa, creative economy IP protection The Architecture of African IP: From Creator to Owner A friend of mine, a story artist, once told me she'd written a bible for a show that later got made, minus her name on it. She wasn't lying and she wasn't exaggerating. She just hadn't understood, at the time, that making something and owning something are two completely different jobs, with two completely different skill sets attached. That's the gap I want to talk about. Not the creative gap, Africa's got no shortage of people who can make brilliant work. The ownership gap. The distance between the moment you create something valuable and the moment you actually control what happens to it. Meet the igwes cartoon The Number That Makes This Concrete Here's a figure that stopped me when I first read it. An estimated $286 million in recorded music revenue goes uncollected every year in Kenya and Nigeria alone, according to industry data cited by the U. S. Patent and Trademark Office's IP attaché, Katherine Hiner, at a briefing in Ghana in August 2026. That's not money the industry never made. That's money it made and then lost, because the infrastructure to track, register, and collect on it wasn't there. Hiner put it plainly. "Having a copyright in your work means little if there's no practical means of enforcing your rights". That's the whole article in one sentence, honestly. A copyright is a piece of paper, or these days a database entry, until someone builds the machinery that turns... - Published: 2026-08-26 - Modified: 2026-08-26 - URL: https://theferdyadimefe.com/patient-capital-african-animation/ - Categories: Africa Animation Industry - Tags: African animation, African film fund, funding African studios, Nigeria creative economy GDP Why African Animation Needs Patient Capital and Patient Talent I got asked a version of the same question twice last month, once by a founder pitching me his studio and once by an investor trying to size up whether to back him. Both wanted to know the same thing. How long before this makes money? That question is fair. It's also the wrong question for this industry, at least right now. What African animation and film need isn't a faster return. It's patient capital, money that's willing to sit through a longer build, paired with patient talent, people who get to develop their craft over years instead of one rushed project. Ferdy Adimefe The Industry Is Already Real Money. It's Just Not Priced Like Long-Term Money. Here's a number worth starting with. Africa's film and audiovisual industry generates roughly $5 billion a year in revenue and employs more than 5 million people, according to UNESCO data cited by the African Export-Import Bank (Afreximbank) when it announced a new film fund in May 2025. That's not a hopeful projection. That's current, working revenue. Nigeria's own creative sector currently contributes somewhere between 1. 2% and 2% of GDP and employs about 4. 2 million people. The Ministry of Art, Culture, Tourism and Creative Economy is targeting 2. 3% of GDP and 2 million additional jobs by 2030, according to Minister Hannatu Musa Musawa, who shared those figures during a briefing with Nigeria's National Institute for Policy and Strategic Studies on August 12,...
